Why You Might Receive an Ignition Interlock Device Letter After an OWI Arrest

If you’ve recently been arrested for an OWI in Wisconsin, you might receive an unexpected piece of mail within days of the arrest. The letter usually looks official and claims to help you regain your driving privileges by installing an Ignition Interlock Device (IID).

For many people, that letter creates immediate panic. It can make it seem like your license has already been taken away and that installing an IID right away is the only way to drive again.

In many situations, that simply isn’t true.

These letters are usually advertisements or solicitations from IID companies such as Intoxalock or similar providers. Because OWI arrest records are public information, these companies can access the arrest data and contact individuals shortly after the incident. The message often sounds helpful, but the goal is to sell an installation service.

An OWI Charge Does Not Automatically Require an IID

What these letters often fail to explain clearly is that an ignition interlock device is not automatically required after an OWI arrest.

In Wisconsin, an IID requirement usually happens only after a conviction or a specific court order.

Being charged with an OWI is not the same as being convicted. Until a court orders the installation of an IID, you may not need one at all.

Installing an IID voluntarily does not provide any advantage later in the case. If a judge eventually orders an IID as part of a sentence, time spent using a device before the court order does not count toward the required installation period.

In other words, installing one early may simply cost you money without providing any legal benefit.

When Your License May Still Be Valid

Many people assume their license is already suspended immediately after an arrest, but that is often not the case.

If you refused a chemical test and requested a Refusal Hearing, your license remains valid while that process is pending.

If you took the requested test and are waiting for the results, your license also remains valid during that time.

Even after receiving test results, if you request an Administrative Suspension Hearing and the hearing ultimately finds you subject to an administrative suspension, an IID is still not required to obtain an occupational license at that stage.

When an Ignition Interlock Device Is Actually Required

An IID becomes mandatory only when a court orders it.

This typically happens after an OWI conviction or if a court determines that a test refusal was unreasonable and specifically orders installation of the device.

Until that happens, you should not assume an IID is necessary simply because a company mailed you a letter suggesting it.

Companies that install ignition interlock devices make money from those installations. They are not responsible for advising you about the legal requirements of your OWI case, and they cannot determine whether you need the device.

Only the court and the Wisconsin Department of Motor Vehicles can determine when an IID is legally required.
